Terms & Conditions
These Terms and Conditions (“Terms”) govern your use of the services provided by Petal Fresh Dry Cleaners (“we,” “us,” or “our”). By placing an order with us, you agree to be bound by these Terms. Please read them carefully.
1. Orders and Acceptance
- These Terms apply to any order placed through our website, by phone, email, or in person.
- Submission of an order does not constitute acceptance. We will confirm acceptance of your order in writing or via electronic communication.
2. Cancellations
- You may cancel your order up to 3 hours before the scheduled collection time at no cost.
- Cancellations made within 3 hours of collection may incur an administrative fee of $6.
3. Collection and Delivery
- We will make reasonable efforts to collect and deliver items at the specified times but do not guarantee precise timings.
- If you are unavailable to accept delivery, a re-delivery fee of $11 will apply.
- If items remain undelivered for 60 days from the invoice date, they will be deemed abandoned, and we may dispose of them at our discretion.
- There is a minimum charge of $55 for all pick-up and delivery services.
4. Payment Terms
- Payment is required in full before delivery of cleaned items.
- We accept payments via Credit Card or Debit Card through our secure online payment system. A merchant fee of up to 2.3% applies to all card payments.
- Late payments may incur interest at a rate of 15% per annum and any associated recovery costs.
5. Customer Responsibilities
- You are responsible for ensuring all items are free from foreign objects (e.g., tissues, pens, keys, coins). We accept no liability for damage caused by such items.
- Items requiring special care must be clearly identified at the time of order. If no instructions are provided, we will clean items using standard methods.
6. Liability and Disclaimer
- We will take reasonable care of your items while in our possession.
- If damage occurs due to our fault, we will refund the cost of the cleaning service for the affected item. We are not liable for damages inherent to the cleaning process or caused by pre-existing conditions (e.g., weak fabric, unmarked stains).
- We do not guarantee the removal of all stains. Additional charges may apply for stain removal services, which must be requested separately.
- Our services exclude liability for indirect or consequential losses, including loss of business or profit.
7. Service Limitations
- We utilize standard cold washing and drying processes unless otherwise requested.
- While we attempt to separate items by color (e.g., lights and darks), we accept no responsibility for color bleeding or transfer.
8. Dispute Resolution
- Any disputes must be raised in writing, detailing the nature of the issue, the desired outcome, and actions believed necessary for resolution.
- Both parties will negotiate in good faith to resolve disputes amicably before pursuing legal action.
9. Privacy and Data Protection
- We use your personal information to:
- Provide our services.
- Process your payments.
- Inform you about similar services, unless you opt out via the “Unsubscribe” link in our emails.
- We do not share your personal information with third parties, except where necessary to fulfill our services.
10. Force Majeure
- We are not liable for delays or non-performance caused by events outside our reasonable control (e.g., natural disasters, power outages).
11. General
- These Terms represent the entire agreement between you and Petal Fresh Dry Cleaners, superseding any prior agreements.
- Any waiver of rights must be given in writing to be effective.
- If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full effect.
- We may assign or transfer our rights under these Terms without your consent.
12. Governing Law
- These Terms are governed by the laws of Western Australia and are subject to the exclusive jurisdiction of the courts in that region.
